The Gallup-McKinley County School District has received and is reviewing the arbitrator's decision regarding Sawyer Masonjones. We respect the arbitration process required under the New Mexico School Personnel Act, and the District will comply as required.
At the same time, the District is disappointed in this outcome. The arbitrator's decision confirms that the District proved, by a preponderance of the evidence, that Mr. Masonjones engaged in both Misconduct and Insubordination. That sustained record included inconsistent attendance practices that left the District unable to reliably account for students' whereabouts; failure to consistently provide the instructional engagement and supervision required of a classroom teacher; a pattern of conducting Union business during instructional time after receiving a direct administrative instruction to stop; and inadequate response to known student vaping in the classroom.
These are not minor or technical findings; they go to core responsibilities the District entrusts to every licensed teacher: accounting for students, maintaining a safe and supervised classroom, and following lawful administrative direction.
We disagree with the arbitrator's conclusion that the District overreacted, or that the discharge was a disproportionate response to the conduct proven. We further disagree with the conclusion that a District must put on direct student testimony to demonstrate that its students have not been provided with the instruction, supervision, and safety they deserve. Student safety, classroom accountability, and staff compliance with administrative direction are not areas where the District is willing to accept a diminished standard, and we are concerned that this decision may make it more difficult for districts to act decisively when these responsibilities are not met.
The District is currently evaluating this decision with legal counsel and will pursue any additional remedies available to it under the New Mexico School Personnel Act and applicable law. Regardless of the outcome of that review, the District will continue to hold all staff accountable to the standards our students, families, and communities expect and deserve.
Congratulations, McKinley Academy!
